For the development of the Syngenta® My Experience program, the client will provide Syngenta, its subsidiaries, subcontractors or external suppliers with certain information that is considered "privileged" and that is intended to facilitate the client's quick and easy obtaining of the benefits of the Program.

Transfer and data transmission

Your personal information will be transferred to the designated provider for the purposes of program implementation. No other use of your personal information will be protected or authorized without your prior consent.

The personal data collected by Syngenta by any electronic or printed means for the purposes of the implementation of the program may not be transferred without the express authorization of the user. The personal data of the client and those of the participants designated by him (dependent of agroservices) as well as the derivatives of contractual relations, will be treated in the terms of the applicable law, for its storage, identification, administration, analysis, operation and / or express disclosure for the effective execution of this loyalty program. These data can be transmitted to subsidiary companies and third parties with contractual relationships with the company. For this, the corresponding contract will include a clause where subsidiary companies and third parties grant the level of protection of personal data required by law.

The Syngenta entity will not disseminate, distribute or commercialize the personal data obtained by virtue of the use of My Syngenta® Experience.


TERMS AND CONDITIOS

  1. My Syngenta® Experience is a program designed to reward agro-service owners and counter clerks striving to offer Syngenta® products to their customers.
  1. The program mechanics consists on the earning of points that might be exchanged at any given time for any of the items on a previously approved catalog available via several communication media (website, mobile app and the customer support line).
  1. For the owner and the clerks to register they shall fill the subscription form (MES2019-A) with accurate data and signature in accordance to the terms and conditions attached to the form. The owner is also responsible for the inclusion of clerks and complete the required data according to numeral 4 of this regulation.
  1. Owners have the right to sign up a clerk to the My Experience Syngenta® program for every 20,000 USD of the agreed goal signed on the Bonus Program Agreement with a maximum of 10 clerks per company.
  1. Two types of points are defined within My Experience Syngenta®:
    1. Participation points: owners and clerks are given this type of points automatically by being active users of the program i.e. welcome bonus and birthday bonus. The welcome bonus will be achieved only once and to those new participant agro-services (points will be awarded exclusively to the owner and are non-transferable).
    2. Purchase points: Owners and clerks are rewarded throughout purchases of Syngenta® products (base and strategic products). For more information regarding specifics for points accumulation please visit: www.myexperiencesyngenta.com and log in with your username and password.

    Points are non-transferable and will expire the last day of February of the next year.
    Points are rewarded by the purchase of products stated on the current signed Agro-service Bonus Program.
  1. Participating Products: The following categories of products have been defined:
    1. Strategic Products
    2. Basic Products

    For info regarding the category of a specific product, please refer to the website or your Syngenta® technical sales representative.
    Commodity products do not apply in the program and will not be rewarded in any way.

  1. Point transfer: Points are non-transferable within clerks nor owners. Validity of the points will be stated on the user statement on a monthly basis (In the website and mobile app) and quarterly (via digital statements). In the case of a clerk ceasing to work with the Agro-service his or her points will be lost as long as those are not redeemable for any reward because of the low amount of points. It is responsibility of the owner to inform Syngenta® when any participating clerk finishes his or her work relationship with the Agro-service in order to be unsubscribed of the program.
  1. Points awarding: User statements will be updated on the first 15 days of the quarterly cut off (April 15th, July 15th, October 15th, 2019 and January 15th, 2020). Participants will be able to check their balance on a monthly basis on the 15th day of every subsequent month (This balance will reflect deductions made through award redemptions and available credits awarded by purchases made automatically through the awarding system). If any error or omission of purchase either strategic or base products, user must notify within 30 days after receiving the statement to the program customer support center requesting the missing points. Later notifications will not be processed.
    1. Statement delivery method. User statements will be sent via electronic media and might be reviewed through the mobile app or website. In the case that any owner or clerk prefers a printed copy, please request it through the website or customer support center.
  1. Points validity: Points will be cumulative from January 1st to December 31st, 2019. Points will not be carried on to the next year.
    1. Points have no monetary value, are only exchangeable for rewards found on the published catalog via the website or mobile app.
    2. After the year closure, users will have a 60-day period to redeem accumulated points, after this period ends points will be lost.
    3. Last day for point redemption is February 28th, 2020, for Agro-services and clerks. Period extensions are not granted under any circumstance.
  1. Deliveries and Point Redemption. Rewards are subject to change without prior notice and will be replaced for similar brand/model. Please refer to warranty policies on the program website.

    Rewards for Agro-service owners and clerks will be delivered on the Agro-service registered address which shall not be modified under any circumstance. The user will be contacted in order to define the delivery schedule using the data given at the time of the redemption. Participants are responsible to provide data as accurate and actual as possible and Syngenta won't be responsible for delays on deliveries caused by wrong or incomplete data.
  1. The "2 call rule" will be used, the user will be contacted in order to coordinate date and time for the reward delivery. If the contact is unsuccessful after 2 attempts, the reward will be delivered in Syngenta Offices for the participant to pick the reward and Syngenta won't be responsible for deliveries after 20 working days.
    1. By compliment of the "2 call rule" the user will be contacted with a text message to the mobile phone stating the place where the reward will be delivered (Syngenta offices in cases where the company has a local office; administrative offices of the logistics service supplier on each participating country and administrative offices of the reward selling company - on this case; if authorized, delivery will take place on a sales floor aiming to be as near as possible to the participant location.
    2. Rewards will be delivered upon exhibit of original id (or authenticated copy in case of loss) of the redeeming participant and won't be delivered to anybody else.
    3. Counter clerks and owners are responsible for their individual redemptions and deliveries.
    4. Rewards will be delivered against a reception signature made by the redeeming participant subscribed to the program on the delivery date. The document to be signed will state name, id number, reward description and reception date. Without the signature on the receipt reward won't be delivered and a new delivery schedule must be made.
  1. Other Clauses:  
    1. Syngenta won't be responsible for damage or prejudice participants, their successors or third parties might suffer through out their participation on the program and/or the use of the rewards, declining all contractual responsibility and/or extracontractual, accepted under no conditions for every participant just by the sole fact of participating on the program.

    2. Syngenta won't be responsible for malfunction of the telephone network, postal or digital services, nor technical difficulties and/or human error or deliberated actions of third parties that might interfere or alter the program development.
    3. Syngenta grants no warranty of quality or any other related to the offered rewards. Any claim must be made directly to the supplier or service provider of the specific reward. Syngenta responsibility ends at the time of reward delivery. In case that the reward can not be made effective or temporary suspended, by major force or causes or fortitude or any motive unrelated to Syngenta, this will not have responsibility towards the participant.
    4. Once rewards are delivered, Syngenta is totally free of responsibility according to the properly stated reward.
    5. Syngenta® reserves the right to change or suspend totally or partially the basis of this program (with notification via the website) in any case honoring the customer acquired rights, meaning the benefits already acquired in points.
    6. For development of the program My Experience Syngenta® the customer shall provide Syngenta®, its subsidiaries, sub-contracted or external suppliers personal data that will be considered "privileged" and its only objective is to facilitate the user a quick and easy way to obtain the program benefits. Your personal information will be transferred to the designed supplier for the program implementation effects. No other use of your personal information is protected nor authorized without prior explicit consent. Personal data collected by Syngenta® by any electronic or printed media for implementation of the program will not be transferred without user authorization. Personal data of the customer and those derived from contractual relationships will be treated on the same terms of applicable law, for storage, identification, management, analysis, operation and/or expressed disclosure for the effective execution of the loyalty program. Such data might be transmitted to subsidiaries and third parties with contractual relationships with the company. In order to achieve that, the corresponding contract will have a clause stating that those subsidiaries and third parties will handle data with the protection level required by law. Syngenta® will not disclose, distribute or profit with obtained personal data through the use of My Experience Syngenta® program.
